INTERIM REGULATORY MEASURES ON THE EMPLOYMENT OF FOREIGN PROFESSIONALS IN SCHOOLS RUN BY NON-GOVERNMENTAL ORGANIZATIONS AND CHINESE-FOREIGN JOINT VENTURE SCHOOLS.
These measures formulated for the purpose of regulating and strengthening the administration of the employment of foreign professionals in schools in schools run by non-governmental organizations and Chinese-foreign joint venture schools, so as to improve the efficiency of the employment.
QUALIFICATIONS AND CONDITIONS
Article 1 Schools run by non-governmental organizations that have independent legal person qualification may apply for the qualification of employing foreign professionals (foreign cultural and educational experts ) in accord with required procedures only when they have stable teaching staff, sources of students and teaching order and have had more than one year's operation. The Chinese-foreign joint venture schools that are formally established and have the independent legal person qualification may apply for the qualification of employing the foreign professionals in accord with required procedures.
Article 2 For Chinese-foreign joint secondary-level schools that do not have independent legal personal qualification, their employment of foreign professionals should be the responsibility of their principal schools that have legal person qualifications.
Article 3 The schools run by non-governmental organizations and Chinese-foreign joint venture schools, when applying for the qualification of employing foreign professionals, should provide the following documents:
(1) Certificates of legal person qualification;
(2) License for running a school;
(3) Certificate of capital for running a school;
(4) Application Form for the Qualification of Employing Institutions for Foreign Cultural and Educational Experts and related attachments required by the Form.
THE PROCEDURE AND RANGE
Article 4 The procedure of application for qualification of employing foreign experts by schools run by non-governmental organizations and Chinese-foreign joint venture schools the same as that for state-owned schools, in accord with the Regulatory Measures on the Employment of Foreign Professionals in Schools and Other Educational Institutions (Wai-Zhuan-FaNo.82(1996)) and Measures on the Qualification Approval of Host Institutions for Employment of Foreign Cultural and Educational Experts ( Wai-Zhuan-FaNo.170(1992)),using the new application form in Document Wai-Zhuan-FaNo.4(2000).
Article 5 Application for qualification of employing foreign professionals by pre-school education and nine-year compulsory education institutions should in principle refer to regulations and policies for state-owned schools.
Article 6 The procedures of employing foreign professionals by schools and kindergartens specially for the children of foreigners will be handled by provincial, autonomous region and central-governed municipal foreign affairs office and education depart-met (bureau), together with local public security organs in accord with relevant regulations.
ADMINISTRATION ENFORCEMENT
Article 7 In order to protect the legitimate rights and interests of both school and foreign professionals and maintain the healthy and orderly development of employment of foreign professionals by schools run by non-governmental organizations and Chinese-foreign joint venture schools, a bail system is set up for the two types of institutions mentions above.
Article 8 After obtaining qualification through examination, schools run by non-governmental organizations and Chinese-foreign joint venture schools should in a bail of RMB10,000 to the account appointed by provincial education department, which will be used to compensate the possible damages incurred by breach of the employment contract, and the sum used for compensation should be replenished within the same year; if there is no d
